Terms of service

  1. Scope of Application

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Dr & Dr Middle Eastern Culture and Foodlab GbR, Reichenbergerstr. 116, 10999 Berlin, Germany (hereinafter referred to as the "Seller") shall apply to all contracts concluded between the Seller and consumers or traders (hereinafter referred to as the "Client") relating to the goods, vouchers, cooking classes and services presented in the Seller’s online shop.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession.

1.3 A trader within the meaning of these GTC is a natural or legal person or a partnership with legal capacity acting in exercise of their commercial or independent professional activity.

1.4 Deviating terms and conditions of the Client shall not apply unless expressly agreed otherwise.

  1. Conclusion of Contract

2.1 The product descriptions presented in the online shop do not constitute legally binding offers, but serve as an invitation to submit an order.

2.2 By completing the electronic ordering process and clicking the button finalizing the order, the Client submits a binding offer to conclude a contract.

2.3 The Seller may accept the offer within five (5) days:

by sending an order confirmation by e-mail,
by delivering the goods,
or by requesting payment.

2.4 The contract language is German. English translations provided in the online shop are for convenience only. In case of discrepancies, the German version shall prevail.

2.5 Order processing and communication generally take place via e-mail. The Client must ensure that the e-mail address provided is correct and capable of receiving messages.

  1. Right to Cancel

3.1 Consumers generally have a statutory right of withdrawal.

3.2 Detailed information regarding the right of withdrawal is provided separately in the Seller’s cancellation policy.

3.3 According to § 312g para. 2 no. 9 BGB, no right of withdrawal exists for bookings of cooking classes or events with fixed dates or periods.

3.4 The Seller may nevertheless offer goodwill-based rebooking options in cases such as illness or emergencies. There is no automatic entitlement to rebooking.

3.5 If a consumer has a statutory right of withdrawal and the contract was concluded through the Seller’s online shop, the consumer may also exercise the right of withdrawal by using the electronic withdrawal function provided in the online shop.

3.6 The electronic withdrawal function is made available through a clearly labelled button or link such as “Withdraw from contract” or an equivalent clear wording. Through this function, the consumer may provide or confirm the information required for the withdrawal, in particular the consumer’s name, information identifying the contract or order, and an electronic communication method for receiving the confirmation of receipt.

3.7 After providing or confirming the required information, the consumer may submit the withdrawal electronically by using a clearly labelled confirmation button such as “Confirm withdrawal” or an equivalent clear wording.

3.8 After receipt of the electronic withdrawal declaration, the Seller shall send the consumer a confirmation of receipt without undue delay on a durable medium, usually by e-mail. This confirmation shall include at least the content of the withdrawal declaration as well as the date and time of receipt. The confirmation of receipt does not constitute a confirmation that the withdrawal is legally valid in each individual case; the legal assessment remains reserved.

3.9 The use of the electronic withdrawal function is not mandatory for the consumer. The consumer may continue to exercise the right of withdrawal by any other clear statement, in particular by e-mail, in accordance with the cancellation policy.

  1. Prices and Payment Conditions

4.1 All prices displayed in the online shop are total prices including statutory VAT where applicable.

4.2 Shipping costs are displayed separately during checkout.

4.3 The following payment methods may be offered:

4.4 Payment processing is carried out through Shopify Payments and associated payment providers.

4.5 If Klarna payment methods are selected, payment processing is handled by Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, subject to Klarna’s terms and conditions.

  1. Shipment and Delivery Conditions

5.1 Delivery shall be made to the delivery address specified by the Client.

5.2 Delivery times are generally:

Germany: 2–5 business days
European Union: 2–8 business days
International shipments may vary depending on destination and customs processing.

5.3 Shipping costs currently are:

Germany: EUR 4.50
Free shipping in Germany from EUR 40 order value
European Union: EUR 9.99
International shipping: EUR 19.99

5.4 The Seller currently ships primarily within Germany, the European Union and Switzerland.

5.5 In case delivery fails due to incorrect information provided by the Client, additional shipping costs may be charged.

5.6 Digital vouchers are delivered via e-mail. Physical vouchers and goods are delivered by postal shipment.

5.7 Product images shown in the online shop may differ slightly from the actual products due to lighting, screen settings or handmade production characteristics.

  1. Product Information and Food Products

6.1 The Seller offers tea, spices and other shelf-stable food products.

6.2 Product descriptions, ingredients, allergens, filling quantities and storage recommendations are provided to the best of the Seller’s knowledge.

6.3 The Client is responsible for checking ingredients and allergen information before consumption.

6.4 Ground prices according to applicable German pricing regulations are displayed where legally required.

6.5 Food products should generally be stored in a cool, dry place away from direct sunlight.

  1. Gift Vouchers

7.1 Gift vouchers purchased through the online shop may be redeemed exclusively through the Seller’s online shop unless otherwise stated.

7.2 Gift vouchers may be provided digitally or physically.

7.3 Gift vouchers are transferable.

7.4 Gift vouchers and remaining balances expire at the end of the third year following the year of purchase.

7.5 Cash redemption is excluded.

  1. Reservation of Proprietary Rights

The goods remain the property of the Seller until full payment has been received.

  1. Warranty

9.1 The statutory warranty rights apply.

9.2 Minor deviations in color, packaging or presentation due to technical display differences or handmade characteristics do not constitute defects.

  1. Liability

10.1 The Seller shall be liable without limitation in cases of intent, gross negligence, injury to life, body or health, and mandatory statutory liability.

10.2 In cases of slight negligence, liability shall be limited to foreseeable damages typical for the contract.

10.3 Further liability is excluded to the extent legally permissible.

  1. Applicable Law

11.1 The laws of the Federal Republic of Germany shall apply excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 Mandatory consumer protection laws of the country in which the consumer has their habitual residence remain unaffected.

  1. Alternative Dispute Resolution

The Seller is neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.
